LIMITS OF LIABILITY

Interoperability of products is the responsibility of the product manufacturers.  JK Technologies may be able resolve hardware and software problems between these products, but the time required for such resolution may exceed the hours on an estimate and is billable.  The end user must work with the product manufacturer to resolve any problems, or employ JK Technologies' expertise to help resolve any problems 

IT product availability is fluid and JK Technologies reserves the right to make changes to the products described in estimates at any time and without notice or consequence.  Product information will be provided at the time of purchase.

IN NO EVENT WILL JK TECHNOLOGIES BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR INABILITY TO USE INFORMATIONAL TECHNOLOGIES  OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN PARTICULAR, JK TECHNOLOGIES SHALL NOT HAVE LIABILITY FOR ANY DAMAGE TO HARDWARE, SOFTWARE, OR DATA, INCLUDING THE COSTS OF REPAIRING, REPLACING, INTEGRATING, INSTALLING OR RECOVERING ANY SUCH HARDWARE, SOFTWARE, OR DATA.

All hardware and software warranties shall be provided by the manufacturer.  JK Technologies offers no additional guarantees beyond the claims of the manufacturer.  Support for manufacturer warranties is only included when the client has purchased our maintenance plan.

Any disputes shall be governed by the laws of the Commonwealth of Virginia.  The City of Newport News, Commonwealth of Virginia, shall be the exclusive venue for the resolution of any such disputes.  JK Technologies total liability for all claims will not exceed the price paid for the hardware.   All purchases are made for the client, therefore neither hardware nor software is returnable. 

All estimates are based on our experience.  However, it is impossible to predict every issue that will arise on complex projects and document them on an estimate.  There are always unforeseen issues with IT projects.  We have the expertise to resolve all issues, but may need to contact your application vendors for assistance and details about their products. 

To be clear:

Extra charges, beyond the estimate, may be incurred to complete any project.

Extra labor, above the estimate, may be required to complete any project. 

Products that are not on an estimate may be required to complete any project.   Such products are billable.
